HOW TO EXAMINE PROBATE COURT FILES

INTRODUCTION
Your relationship with our firm will involve visiting the Probate Court on a regular basis, usually at least once a week, to check the recently filed estates numerically, in order to ascertain if there are any cases which may be of interest to us. We strongly suggest that the first time you visit a Court, you go back a period of about three months time. This will allow you to catch up and help familiarize you with the files and forms. When you have completed your search, write down the last number you checked and thereafter, simply start where you left off. If you really wish to do a thorough job, write down any missing numbers in case a file has been signed out and either ask for them or wait until you return again. If you can check more than one Court regularly, please let us know which ones.

DETAILED INFORMATION
There are primarily two types of cases that you will come across: Testate (cases in which there is a Will) and Intestate (cases in which there is no Will).

In each file you will find a form that lists the names and addresses of the relatives and their relationship to the person who died (Decedent). This is called the Petition, and is the most important document to you in the file.

If the petition says that the relatives are: unknown, missing, addresses unknown, cousins, aunts, uncles, stepchildren, in-laws, or the addresses are incomplete, fill out our probate form and mail or fax it to us immediately. If the value of the case is in excess of $10,000, after you have completed the form, go to a phone and call us immediately. You may use our toll free number 1-888-2INHERIT (1-888-246-4374). If possible, call from the courthouse in case we need additional information, but don't let others overhear your conversations or see your paperwork!! This is a highly competitive business. You might also find several other types of cases mixed in with the testate and intestate matters. Sometimes these are called: Caveats, Petitions to Open a Safe Deposit Box, Alcoholics, Adoptions, Change of Name, Guardianships and Incompetencies. Caveats are cases filed by a creditor because there usually are no known relatives and the creditor wants to protect some money due him. Petitions to Open a Safe Deposit Box are cases that are filed because the person who died has a bank safe deposit box and it needs to be opened to see if there is a will. Guardianships and Incompetencies are cases in which a person is still living, but is either mentally or physically incapable. Let us know about these if the value is in excess of $50,000. Do not bother with any other type of case.

COMPENSATION
You shall receive five-percent (5%) of the net fee that our firm retains from the heirs we are successful in locating and signing contracts with.

Your commission will be paid directly to you in full without any deductions, at the same time that we receive our fee. For example, if an estate is valued at $50,000 and we enter into a forty-percent fee with the heirs, and there are no other companies with whom we may be obligated to share our fee, when the case is distributed you will receive $1000.

As you can see, this can be a very lucrative source of additional income with no investment on your part other than your time of an hour or so weekly in the clean pleasant surroundings of a courthouse.

URGENCY
We must stress, and this is MOST IMPORTANT, that although there are not many similar firms, the competition is very keen. Timing is everything in this business. The difference in our getting a case an hour ahead of a competitor can decide who will find the heirs first. Some of our competitors have people doing the same work as you, from within the probate court itself! So, when you come across a case, get the information to us without delay. Also, each Thursday or Friday, please call our office and advise us of the last numbers checked which we will note in a log maintained under your name.

NOT SURE IF A CASE IS GOOD?
Don’t take a chance in guessing. Until you become experienced, call our "800" number and let US decide if you have a questionable matter! It’s better to be safe than sorry.

LOCAL NEWSPAPER ARTICLES
While scanning your local paper, keep an eye out for articles, obituaries or death notices that indicate a person died leaving: a large estate, no known survivors, only cousins or only step-children.

STEP-BY-STEP PROCEDURES

  1. Visit Probate Court and look at Petition for names of relatives.
  2. If relatives are "missing, unknown, none, address unknown, cousins, aunts, uncles or stepchildren" fill out our probate form completely.
  3. Call us collect or on our toll free number and when giving the details, don’t let others overhear your conversation….competitors have big ears!
  4. If in doubt, don’t guess, fill out our probate form and call us from the courthouse.
  5. If it is a case involving a Will, OBTAIN A PHOTOCOPY.
  6. VERY IMPORTANT, if there is a copy of a death certificate in the file get a photocopy or print all of the information on our Death Record form.
  7. If no value is given for the estate, we need to know what the inheritance is for: (i.e., real estate, insurance proceeds, etc.).
  8. Write down the number of the last case you checked at each court, so you will know where to start the next time you visit. Then call us and give us the file number of the last case checked.
  9. PLEASE PRINT ALL INFORMATION NEATLY AND LEGIBLY.
