Probate

The process of probate in the state of California involves determining the obligations of a person's financial and legal matters after their passing. It allows a decedent's assets to be used to pay any creditors, then to pass on to heirs or beneficiaries. Probate is usually a very time-consuming process, taking anywhere from nine months to two years to complete in its entirety. For larger estates, such as anything over $100,000 the court is required to supervise the transactions and distributions.

During probate, the executor named in the Will shall act as the administrator and divvy the assets as directed by the decedent's wishes. If no Will exists, any interested family member may petition the court to seek the rights of administration. This person chosen by the court, named the personal representative, will then act as the administrator and distribute the assets according to California "intestate" laws.
